For the foolish judge Aoun acquitted Fadi, what does the article say in the law?

News websites were filled with the news of Judge Ghada Aoun’s claim of the felony of intentional killing against Dr. Fadi Al-Hashem, the husband of actress Nancy Ajram, according to Article 547, found in Article 229.

The majority reported the news using Copy & Paste technology, believing that Judge Aoun issued a new decision and changed her mind as if she was playing and that it was dangerous for her to return and accuse Dr. Fadi Al-Hashem was deliberately killed and imprisoned for 15 to 20 years.

However, according to Lebanese law, Judge Ghada Aoun and in the context of the procedures followed claimed Fadi Al-Hashem Article 549 of the Penal Code has been added to Article 229 Which states that “the perpetrator shall not be punished for an act that was necessitated by him until he pushed him for himself or for others or for his property or property of others with a serious and imminent danger that he did not intentionally cause provided that the act is proportionate and the danger”

If Judge Aoun intended that Al-Hashem had been killed intentionally and not for the purpose of self-defense, she would have claimed it under Article 549 of the Penal Code and was not conditional on Article 229.

With the spread of the news or the rumor, the lawyer of Fadi Al-Hashem and Nancy Ajram, Gabi Germanos, told MTV that he was not surprised by the current claim against Dr. Fadi Al-Hashem, because the natural path for the file to turn into the first investigating judge in Mount Lebanon, with our assurance that the investigating judge will issue a decision to consider the doctor’s act Fadi Al-Hashem is a legitimate self-defense.

He added: “It is natural for the prosecution to be completed and transfer the file to the first investigating judge in Baabda, who will in turn follow up the investigations, and will verify the validity of all the statements made by Dr. Al-Hashim, and the deed of Dr. Al-Hashim is described as legitimate defense according to what is stipulated in the Lebanese Penal Code.”
