Among the common questions about the provisions of fasting and the statement of legal opinion in it that Masrawy receives, we asked a question to the Al-Azhar International Monitoring and Fatwa Center from a person who says: “Why is penance for sexual intercourse for a man without a woman?”

In his answer, Sheikh Muadh Abdul Rahman Shalabi, a member of the Center’s Electronic Fatwa Committee, said that the expiation for intercourse during the day in Ramadan is necessary for the husband by the agreement of the jurists for violating the sanctity of the month of fasting, and for committing a major sin, citing the hadith of Abu Hurairah, may God be pleased with him, who said: We are sitting with the Prophet, may God’s prayers and peace be upon him, when a man came to him, and he said: O Messenger of God, do I perish, he said: What? He said: I fell on my wife when I was fasting, and the Messenger of God, may God bless him and grant him peace, said: Do you find a neck? He said: No, he said: Can you fast for two consecutive months? He said, “No,” he said, “Do you find food for sixty poor people?” He said: No, he said: The Prophet Fmkt peace be upon him Fbana We, it came to the Prophet peace be upon him the sweat of the pass, and Ethnicity: agglomerated (pot-like unaffordable), said: Where the liquid? He said: I said: Take it incredible him, the man said: Top of the poorest of me, O Messenger of Allah, I swear between the Aptiha wants to Ahartin (ie between the ends of the city), the people of the house of the poorest of the people of my house, laughed the Prophet peace be upon him until the fangs appeared, Then he said: Feed him to your family. [متفق عليه].

Abdel-Rahman added, in his response to Masrawy, that what is now most prevalent in intercourse with the husband and his wife is that he signs him for desire, choice, intent, and not coercion.

He emphasized that saying that the wife does not have to atone for intercourse is absolute; it is a general statement.

Abdel-Rahman explained that many scholars have differentiated between the wife’s consent to sexual intercourse and her coercion over it, and obligated her to offer expiation if she is satisfied with a voluntary obedience, such as the husband, and they did not compel her to do it if she is forced to compel, and he is the one who chooses the fatwa.

And among the fuqaha ‘, they differed as well. Whoever composes his wife during the day in Ramadan is compulsive: Does he have to offer one atonement, or does he have to offer two expiation? And it is more likely that he will need one atonement for the aforementioned evidence, which is the one chosen for the fatwa.

The reason for the disagreement is the hadith mentioned in the above-mentioned issue, as the one who our Prophet, peace and blessings of God be upon him, was the husband, so some jurists understood that the ruling of the Prophet, may God’s prayers and peace be upon him, regarding his matter was his matter without his wife, especially since it is not hidden from the Prophet, peace and blessings be upon him if His wife, and because it is a right of money related to slandering, the man was like a dowry, and some of them are from the said difference.

In all cases, the spouses must spend the day in which intercourse occurred during the day in Ramadan, and repent and seek forgiveness.
